This Privacy Policy describes how Digital Provisions, LLC and its affiliates and subsidiaries (“Digital Provisions,” “we,” “our,” “us”) collect, use, disclose, and protect information in connection with our websites, products, services, support, and communications, including interactions by phone, email, SMS text messaging, and in person.
By using our services or providing information to us, you consent to this Privacy Policy. This Privacy Policy is incorporated by reference into our Terms and Conditions.

1. Scope
This Policy applies to information we collect from customers, prospective customers, website visitors, vendors, and other business contacts in the United States. It is intended to meet applicable federal and New York State requirements, including the New York SHIELD Act (N.Y. Gen. Bus. Law § 899-aa and § 899-bb) with respect to safeguarding private information and breach notifications.
2. Categories of Information We Collect
We may collect the following categories of information directly or indirectly:
- Personal identifiers name, mailing address, email address, telephone number, company, job title, and account credentials.
- Service and transaction information project details, site and system information you provide, service tickets, schedules, installation and maintenance history, invoices, and related records.
- Communications and support content emails, phone recordings when applicable, meeting notes, and SMS content and metadata such as the mobile number, opt-in status, and opt-out requests.
- Technical and usage data IP address, device and browser type, pages visited, session logs, cookies, local storage, and related analytics.
- Payment information billing address and limited payment method details that are processed by PCI-compliant payment processors on our behalf. We do not store full card numbers.
- Compliance and security logs access logs, audit logs, and other records necessary to protect our services and fulfill legal obligations.
We do not intentionally collect sensitive personal information such as government ID numbers, precise geolocation, health data, or biometric identifiers unless you choose to provide them in the context of our work for you, and only to the extent necessary for the service.

We collect information from:
- You directly through forms, statements of work, emails, SMS, phone calls, meetings, and uploads.
- Your company representatives and authorized users.
- Our websites and portals through cookies (if opted in) and similar technologies.
- Service providers and partners that support our operations payment processors, carriers and messaging platforms, hosting and analytics vendors, and technical subcontractors.
4. Purposes for Use
We use information to:
- Provide, operate, and support our security integration and related services.
- Coordinate projects, service tickets, scheduling, and customer communications.
- Communicate via SMS on a conversational, person-to-person basis as permitted by law and carrier rules.

- Protect the rights, property, and safety of Digital Provisions, our customers, and the public, and to prevent fraud, abuse, or misuse.
We do not sell personal information.

- Service providers and vendors under contract who process data on our behalf for hosting, analytics, messaging and telecommunications, payment processing, customer support, shipping, and field services.
- Professional advisers and insurers as reasonably necessary for legal, audit, or insurance purposes.

- Buyers, successors, or assigns in connection with a corporate transaction such as a merger, acquisition, or asset transfer, subject to appropriate confidentiality.
We do not disclose SMS opt-in consent records, mobile numbers, or SMS message content to third parties for advertising or promotional purposes.
6. Cookies and Analytics
We use cookies, web beacons, and similar technologies to enable website functionality, maintain sessions, measure performance, and improve content. You can set your browser to block or delete cookies, though some site features may not function properly. At this time, our services do not respond to Do Not Track signals.
7. Data Security
We maintain administrative, technical, and physical safeguards appropriate to the nature of the information, including access controls, encryption in transit where appropriate, network and application security measures, vendor diligence, workforce training, and incident response procedures. While we take reasonable steps to protect information, no method of transmission or storage is completely secure.
8. Data Retention
We retain information for as long as reasonably necessary to fulfill the purposes described in this Policy, to comply with legal and contractual obligations, to resolve disputes, and to enforce our agreements. Retention periods vary by category of data, applicable law, and operational needs. When data is no longer required, we will securely delete or de-identify it consistent with our policies and applicable law.

11. Data Breach Notifications New York SHIELD Act
If we determine that a breach of the security of our systems has occurred that compromises the security, confidentiality, or integrity of private information, we will provide notifications in accordance with the New York SHIELD Act and other applicable laws.
12. Third-Party Links
Our websites may contain links to third-party sites or services that are not owned or controlled by Digital Provisions. This Policy does not apply to those sites. Review their privacy policies before providing information.
13. Changes to this Privacy Policy
We may update this Policy from time to time. The updated Policy will be posted with a new effective date. Your continued use of our services after the effective date constitutes your acceptance of the updated Policy.
14. Binding Arbitration and Class Action Waiver
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to this Privacy Policy or our data practices will be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You and Digital Provisions waive the right to a jury trial. Claims will be brought only on an individual basis. The arbitrator has no authority to conduct class, consolidated, or representative proceedings. If any portion of this section is found unenforceable, the remainder will remain in effect.

Digital Provisions SMS Messaging Terms of Use

These SMS Messaging Terms of Use govern your participation in the SMS text messaging service offered by Digital Provisions, LLC. By opting in to or using our SMS text messaging service, you accept these SMS Messaging Terms of Use, which are incorporated by reference into our Terms and Conditions and our Privacy Policy.

1. Definitions
“Opting In,” “Opt In,” or “Opt-In” means requesting, joining, enrolling in, signing up for, acknowledging, replying affirmatively to, or otherwise consenting to receive one or more SMS text messages from Digital Provisions. Consent may be provided verbally to a Digital Provisions employee and documented by us, in writing paper or electronic, by submitting your mobile number through a Digital Provisions web form that clearly presents SMS consent, or by replying affirmatively via text message.
“Text Message Service” means any arrangement whereby we transmit one or more messages to your mobile number using SMS, MMS, or successor protocols or technologies, whether initiated by us or sent in response to your message.
2. Nature and Scope of Messages
The Text Message Service is for conversational, person-to-person communications relating to customer service, scheduling, project coordination, product or service status, and similar operational matters. We do not use this service for marketing or promotional messages without separate, affirmative consent expressly for marketing.
Consent to receive SMS is not a condition of purchase. If you do not consent, we may still communicate with you through other channels such as email or phone.
3. Consent and E-SIGN Disclosure
By consenting to receive text messages, you agree to these SMS Messaging Terms of Use, our Terms and Conditions, and our Privacy Policy. You consent to the use of an electronic record to document your agreement. You may withdraw consent to the electronic record by sending STOP to any message or by contacting support@digitalprovisions.com. If you withdraw consent, we may need to communicate with you via other channels.
4. Message Frequency
Upon enrollment, you may receive a confirmation or informational message. Thereafter, the number of messages you receive will vary depending on your interactions with our staff, your account activity, and the nature of your requests.
5. Costs
Digital Provisions does not charge a fee for participation in the Text Message Service. Message and data rates may apply according to your mobile carrier and plan. You are responsible for any such charges.
6. Opt-Out and Help
You may opt out at any time by replying to any message with STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or REVOKE. After we receive your request, we will send one final message to confirm the opt-out. You may re-enroll at any time by replying START or UNSTOP, or by providing new consent.

Because this service is conversational and may originate from different Digital Provisions employee numbers, an opt-out sent in a particular conversation thread will stop messages from that specific sender ID. If you wish to opt out of all Digital Provisions SMS communications across all numbers, contact support@digitalprovisions.com with your request, and we will apply a global block to your number.
7. Privacy and Data Use
Information collected through the Text Message Service is used solely to transmit and respond to your messages and to operate and secure the service. We may share limited information with carriers, SMS platforms, and vendors only as necessary to deliver messages and maintain the service. We do not sell mobile numbers, SMS content, or opt-in data and we do not share such information with third parties for promotional purposes. These SMS terms supplement, and do not replace, our Privacy Policy.
8. Device, Carrier, and Availability
Delivery of messages is subject to effective transmission by your mobile carrier or network operator and is outside our control. Carriers are not liable for delayed or undelivered messages. The service may be unavailable or limited in some areas or at certain times.
9. User Responsibilities
You represent and warrant that you are the owner of, or authorized user for, the mobile number you provide and that you will notify us if your number changes or is reassigned. You are responsible for ensuring that messages do not contain confidential or sensitive information you do not wish to transmit by SMS.
10. Recordkeeping
We may maintain records of consent, opt-in, opt-out, and message logs as necessary to operate the service, comply with legal obligations, and demonstrate compliance with telecommunications and consumer protection requirements.
11. Termination or Suspension
We may suspend or terminate your participation in the Text Message Service at any time for any reason, including suspected misuse, violation of these terms, operational necessity, or to comply with law or carrier requirements.
12. Changes to these SMS Terms
We may update these SMS Messaging Terms of Use from time to time. The updated terms will be posted with a revised effective date. Your continued participation after the effective date constitutes acceptance of the updated terms.
